Starry Elf Studios understands that your slides, photos, and videos contain precious memories, and we treat them with respect and care as if they were our own.

Elves do not like legalese, but to protect our studio and to provide quality services at affordable prices we must insist on the following:

Disclaimers, Terms & Conditions of Service:

30 Day Window for Disputes

The Client must notify Starry Elf Studios (hereafter “The Studio”) in writing of any claim concerning any invoice within 30 days of the date of the invoice. The Studio will not be liable in respect of any claim notified after such time.

Studio’s Limited Liability for Lost/Damaged Goods

By submitting any film, VHS tape, or any other media to The Studio for processing or any other handling, the Client agrees that if such film, VHS tape, or any other media is damaged, lost, or mishandled by The Studio, even though due to negligence or other fault, liability will be limited to replacement of an equivalent amount of unexposed blank tape or other blank media and processing from The Studio. The foregoing will be the Client’s exclusive remedy for any such loss, damage, or mishandling. Except for such replacement, the acceptance for processing, or handling of any film, VHS tape, or any other media is without warranty whatsoever (whether expressed or implied) or other liability of any kind. Recovery for incidental or consequential damages is specifically excluded.

If The Studio is unable to fulfill order due to circumstances beyond the Studio’s control

The Studio will not be liable for any failure to perform, any contract between The Studio and the Client which is due to any circumstances beyond The Studio control including (but not limited to); inability to secure materials, supplies or transport; or scarcity of fuel, power or components; or machine breakdown, theft, vandalism, fire, storm, flood, other act of God, war, civil disturbance, or other action beyond the control of the Studio.

Client Promises to Pay

The Client promises to pay in full any moneys owed to The Studio and understands that failure to make full payment will result in The Studio withholding the Client’s deposited materials (VHS tapes, etc.) and any Studio-produced work until payment in full is received. The Client also understands and agrees to pay an additional 5% penalty on all outstanding balances due if not paid after 30 days of due date indicated on the invoice.

The Client hereby declares the following statement: ”I am 18 years of age or older, and I am competent to contract in my own name, and I have read, understand, and agree to be bound by the terms and conditions of this order form.”

Before accepting an order, Starry Elf Studios must have a signed copy of this form, indicating that the customer accepts these terms and conditions.
